Information sheet for informing the traveler of a package tour according to § 651a of the German Civil Code
The combination of travel services offered to you is a package tour within the meaning of the Directive (EU) 2015/2302.
Therefore, you can make use of all EU rights that apply to package tours. Van der Valk Hotel Hildesheim GmbH is fully responsible for the proper performance of the entire package tour.
In addition, Van der Valk Hotel Hildesheim GmbH has the legally required insurance for the repayment of your payments and, if transportation is included in the package tour, for ensuring your return transportation in case of their insolvency.
Main rights under the Directive (EU) 2015/2302
Travelers receive all essential information about the package tour before the conclusion of the package travel contract.
At least one organizer is always liable for the proper performance of all travel services included in the contract.
Travelers receive an emergency phone number or contact information to reach the tour operator or travel agency.
Travelers can transfer the package tour to another person within a reasonable period and under certain circumstances, possibly for additional charges.
The price of the package tour may only increase if specific costs (such as fuel prices) rise, and if this is explicitly stated in the contract, and in any case, at the latest 20 days before the start of the package tour. If the price increase exceeds 8% of the package travel price, the traveler can withdraw from the contract. If a tour operator reserves the right to a price increase, the traveler has the right to a price reduction if the corresponding costs decrease.
Travelers can withdraw from the contract without paying a withdrawal fee and receive a full refund of all payments if one of the essential elements of the package tour, except the price, is significantly changed. If the organizer responsible for the package tour cancels the package tour before it starts, travelers are entitled to a refund and possibly compensation.
Travelers can withdraw from the contract without paying a withdrawal fee in the event of extraordinary circumstances before the start of the package tour, for instance, if there are serious safety problems at the destination that are expected to affect the package tour.
Furthermore, travelers can withdraw from the contract at any time before the start of the package tour upon payment of a reasonable and justifiable withdrawal fee.
If essential elements of the package tour cannot be carried out as agreed after the package tour has started, the traveler must be offered appropriate alternative arrangements at no extra cost. The traveler can withdraw from the contract without paying a withdrawal fee (in the Federal Republic of Germany, this right is known as "termination") if the services are not provided in accordance with the contract, and this has significant consequences for the performance of the contractual package travel services and the tour operator fails to remedy this.
The traveler is entitled to a price reduction and/or compensation if the travel services are not performed or performed improperly.
The tour operator provides assistance to the traveler if they find themselves in difficulties.
In the event of the insolvency of Van der Valk Hotel Hildesheim GmbH, payments will be refunded. If the insolvency of Van der Valk Hotel Hildesheim GmbH occurs after the package tour has started and transportation is part of the package tour, the return transportation of travelers will be guaranteed. Van der Valk Hotel Hildesheim GmbH has taken out insolvency insurance with R+V Allgemeine Versicherung. Travelers can contact R+V Allgemeine Versicherung AG, Raiffeisenplatz 1, 65189 Wiesbaden, +49 611 533-5859, if services are denied to them due to the insolvency of Van der Valk Hotel Hildesheim GmbH.
